Lafayette attorney Earl McCoy is wanted on warrant for his arrest in his charge of attempted sexual battery.
Special Judge Heather Barajas signed the warrant on Friday, setting his bail at $2,000 cash only, according to the warrant.
McCoy has not yet been arrested or booked into the Tippecanoe County Jail as of around noon Monday.
The Journal & Courier left a voicemail for McCoy asking for comment and inquiring when he might turn himself in to authorities. He has not returned the call.
McCoy hired Lafayette attorney Brian Dekker to represent him. Dekker filed a motion with the court March 17 asking that a warrant not be issued for McCoy’s arrest. Instead, the motion requested that an initial hearing be set and that McCoy will attend, according to the motion.
Barajas’ signature on the warrant makes McCoy’s motion moot.
A special prosecutor charged McCoy on March 16 with attempted sexual battery, a Level 6 felony.
McCoy recently served as WLFI-TV18’s on-air legal analysist for the Delphi murder case against Richard Allen, who is accused of killing teenagers Libby German and Abby Williams on Feb. 17, 2017.
In 2018, McCoy was a GOP candidate for Tippecanoe County prosecutor. However, he lost in the primary.
McCoy, 53, and some of his employees went out for drinks on May 6, 2022, and as the group began to break up, McCoy asked a woman employee to let him back into the office, claiming he forgot his keys, according to prosecutors’ probable cause affidavit.
After the woman let him back into the office, he spoke with her in the conference room and began to asking her sexual questions, according to prosecutors. He then tried to kiss her, which was when the woman pulled away from him, according to the affidavit.
McCoy pinned her in the room, grabbed her hand and tried to force it to his crotch, according to the affidavit.
The woman freed herself from the encounter and later reported it to police, according to the affidavit.
When interviewed by police, McCoy admitted trying to kiss the woman, but he denied trying to force the woman to touch him, according to prosecutors.
