The widow of the accused “Duck Sauce killer” Glenn Hirsch, is headed to trial on gun possession charges, a Queens judge ruled Wednesday.
Dorothy Hirsch, 64, was busted the day after her estranged husband’s arrest in the April 30 slaying of beloved Chinese-food deliveryman Zhiwen Yan, 45.
Cops found eight guns stashed in a closet in her home, in bags, with one wrapped in tinfoil, prosecutors said.
Glenn Hirsch allegedly fatally shot Yan, an employee of the Great Wall restaurant in Forest Hills over a months long grudge over Hirsch’s belief he didn’t get enough duck sauce packets with a meal, according to prosecutors.
Yan was gunned down while on his delivery scooter near 108th St. and 67th Drive in Forest Hills, police said.
Dorothy Hirsch’s lawyers tried to get the charges against her tossed, but Judge David Kirschner denied their motion Wednesday.
“She’s very disappointed, as am I,” said attorney Mark Bederow. “Dorothy was indicted on cherry picked evidence. We brought to the attention of the District Attorney numerous pieces of evidence which we simply asked for them to present to the grand jury to hear the full story. They refused to do that.”
While unhappy with the judge’s decision Dorothy Hirsch and her defense see the advantage of going to trial.
“I’m not dismayed in the least bit,” said Bederow. “The playing field will be much more level.”
The way in which the weapons were stored is one of the pieces of evidence that was not allowed to be presented to the grand jury, Bederow said.
Likening the multiple layers of bags, foil, and boxes to “Russian nesting dolls,” the lawyer pointed out that Glenn Hirsch’s home in a state of disarray with hoarded items.
Glenn Hirsch committed suicide on Aug. 5, and left a note that claimed ownership of the guns and exonerated his wife. The note is another piece of the puzzle that will now be presented to a jury, Bederow said.
A trial date will be set next month.
“For lawyers, you beg for a case like this, she is 100% innocent,” said Bederow. “There will not be any plea bargaining, there isn’t going to be a guilty plea. This is all or nothing.”
