Andover Village Mayor David T. Truax faces new criminal charges, including felony criminal contempt, after his third arrest in about six months.
On June 15, Amity-based State Police charged Truax, 49, with felony first-degree criminal contempt, fourth-degree criminal mischief, a misdemeanor, and second-degree harassment, a violation.
Troopers said they responded shortly before 11 p.m. on June 15 to Grove Street in Andover for a “domestic dispute” in which an alleged victim sustained a minor injury and property was damaged.
Truax, according to State Police, violated an existing order of protection during the incident.
The order stemmed from an arrest in March when the Republican mayor of the 900-resident village in Allegany County was charged with third-degree assault, fourth-degree criminal mischief and second-degree unlawful imprisonment in connection with a March 11 “physical domestic.”
Truax was arraigned in Friendship Town Court on the latest charges and released with a return date of June 26.
Reached Tuesday, Truax said he has no plans to resign as mayor. He said all the charges from his March arrest were dismissed and he deserves the presumption of innocence on the latest counts.
The Allegany County District Attorney’s Office did not immediately respond to questions about the status of the case from March.
In January, Wellsville village police charged Truax, who was reelected to a four-year term in 2021, with second-degree harassment in connection to a November 2022 incident. Police alleged Truax made physical contact with a person at Better Days Pub & Eatery, the business he owns on North Main Street.
Truax denied wrongdoing in that incident, saying he was reacting to threats against himself and a family member.
